After the entry into force of RD-Law 16\/2013 of December 20, the specific obligation to register the working day (control working hours) is introduced in the Workers’ Statute.<\/p>\n
In this post, we are going to make a small summary of what was discussed at the conference, in case you could not attend or in case you need to find out about time control.<\/p>\n

The working hour control is mandatory.<\/h2>\n
The most important point, since it refers to those who are obliged to keep time control. The answer is clear and resounding: all workers are obliged to carry it out.<\/p>\n
Nobody can stop doing it, which is why it has become so important, and you should not ignore its relevance. Failure to record hours worked during the week may lead to penalties.<\/p>\n
Ordinary or overtime hours?<\/h2>\n
It is a question that arose during the presentation. Many had doubts, both due to the hours and the type of contract.<\/p>\n
All workers must present timesheets; no one can stop doing it. It does not matter if you work overtime or not. It is also not important whether the contract is part-time or full-time.<\/p>\n
The reality is that it is mandatory for all types of workers and must be done daily, without stopping for a single day.<\/p>\n

What if they work from home?<\/h2>\n
Another of the doubts most discussed by those attending the ETL GLOBAL NEXUM presentation. What happens if the worker spends his day working from home? Is he then exempt from doing it?<\/p>\n
At the risk of seeming heavy, I tell you the same thing again: no one can stop keeping track of time. The worker who does it from home must report the beginning and end of his day.<\/p>\n
He can do it by mail or by phone message, but he must do it without fail and every day.<\/p>\n

How is the time control registered?<\/h2>\n
It must be recorded daily and with monthly reports. It can be registered in 3 different ways:<\/p>\n
\n- Manual registration<\/strong>: the worker signs a sheet each day with the hours worked. All sheets must be signed by the workers without exception.<\/li>\n
- Fingerprint or electronic record<\/strong>: in this case, they do not require the worker’s signature. By doing so through a worker card or fingerprint, it will already be registered electronically. At the end of each month, the summary is made by dumping that data.<\/li>\n
- Via notification<\/strong>: when working from home, it can be done with an email or via SMS. Whenever work begins, it must be reported, and each break must also be reported.<\/li>\n<\/ul>\n
These are the most important points that were discussed during the presentation made at the College of Economists of Barcelona.<\/p>\n
It is a complicated subject, and although it may seem like something out of the past, it should not be taken lightly. Breaking the rule results in fines for the company.<\/p>\n
The worker does not take risks; it is the company who must assume the fine, so the company must take care at all times that the working hours’ control is carried out.<\/p>\n
